Credit Terms

To the fullest extent permitted by law, in no event shall Tel-Conn Holdings, Inc. and any of its parent companies, subsidiaries, affiliates, employees, officers, or agents be liable to prospects, customers, or clients or any third party for any lost profits, lost business, lost revenue, delay, special, consequential, incidental, indirect, punitive, or contingent damages, or any other damages, however arising, even if the parties have knowledge of the possibility of such damages and whether or not such damages are forseeable, whether arising out of breach of contract, warranty, tort (including negligence and strict liability), or other theories of law, with respect to Products, Goods, and/or Services, or omissions relating thereto.

Without limiting the generality of the foregoing, Tel-Conn Holdings, Inc. and any of its parent companies, subsidiaries, affiliates, employees, officers, or agents shall have no liability for property or personal injury damages, penalties, loss of use of Products, Goods, and/or Services, or any associated equipment, cost of capital, cost of substitute Products, Goods, and/or Services, facilities or services, or for any other types of economic loss, or for claims of Buyer's customers, clients, vendors, or any third party for such damages.

Upon receipt of Products, Goods, and/or Services from Tel-Conn Holdings, Inc. and its parent companies, subsidiaries, and/or affiliates, Buyer agrees that all custom-built Products or Goods are to be tested out-of-box to reasonable industry standards upon receipt to ensure safety and all required Buyer specifications are met.

With regard to the foregoing, all custom-built Products or Goods are non-cancellable, non-returnable, and non-reschedulable; any express or implied warranties shall be void if Products or Goods are altered and/or not tested upon receipt.

Availability of material is subject to prior sale.

Freight, shipping, and handling fees or expenses are not included in total pricing, unless otherwise specified. Additional transportation fees may be billed separately (these include, but are not limited to, residential service, liftgate service, reconsignment fees, and delivery service guarantees).

All Orders are subject to a 3% fee if paid by credit card, unless directly specified.

All information included in any quotations or estimates is proprietary and confidential between Seller and the recipient organization. By submitting an Order for Products, Goods, and/or Services quoted by Tel-Conn Holdings, Inc. and its parent companies, subsidiaries, and/or affiliates, Buyer acknowledges and agrees to the conditions above.
